HealMed Privacy Policy

Respect for your privacy is coded into our DNA. Since we started HealMed, we’ve aspired to build our Services with a set of strong privacy principles in mind.

HealMed provides user health assessment, care delivery, and other services to users around the world. Our Privacy Policy helps explain our information (including video and transcript) practices. For example, we talk about what information we collect and how this affects you. We also explain the steps we take to protect your privacy – like HealMed ensures HIPPA compliance on our Services.

When we say “HealMed,” “our,” “we,” or “us,” we’re talking about HealMed Solutions LLC. This Privacy Policy (“Privacy Policy”) applies to all of our apps, services, features, software, and website (together, “Services”) unless specified otherwise.

Please also read HealMed’s Terms of Service (“Terms”), which describes the terms under which you use our Services.

Information We Collect

HealMed receives or collects information when we operate and provide our Services, including when you install, access, or use our Services.

Information You Provide

  • Your Account Information.You provide your name, email ID, mobile phone number,  address and other details as requested by Care Provider either directly or indirectly through your Care Provider. You confirm you are authorized to provide us such data. You may also add other information to your account, as permitted by the App or Website.
  • Your Interactions.While you interact with HealMed Apps, we need to collect your Video and Audio in order to report your responses accurately to your Care Provider. Once your interactions (including your video, audio, telehealth video consultaiton) are delivered, they are deleted from the device you use to take our Services. Your interactions are stored on secure Cloud server following HIPPA compliance. If a message cannot be delivered immediately (for example, if you are offline), we may keep it on our device for up to 30 days as we try to deliver it. If a message is still undelivered after 30 days, we delete it. We also offer end-to-end encryption for our Service. End-to-end encryption means that your interactions are encrypted to protect against us and third parties from reading them.
  • Your Other Medical Information.To serve you effectively, HealMed system will transfer the data we collect from you to your Care Provider’s Electronic Health Record (EHR) system either through system level integration or by providing necessary access to the responsible Care Provider (human) who can upload data manually into their system. HealMed system may also collect some of your relevant medical information from EHR system either through system level integration or by manual input from responsible Care Provider. 
  • Customer Support. You may provide us with information related to your use of our Services, and how to contact you so we can provide you customer support. For example, you may send us an email with information relating to our app performance or other issues.

Automatically Collected Information

  • Usage and Log Information. We collect service-related, diagnostic, and performance information. This includes information about your activity (such as how you use our Services, how various users interact with the system using our Services, and the like), log files, and diagnostic, crash, website, and performance logs and reports.
  • Transactional Information. If you pay for our Services, we may receive information and confirmations, such as payment receipts, including from app stores or other third parties processing your payment.
  • Device and Connection Information. We collect device-specific information when you install, access, or use our Services. This includes information such as hardware model, operating system information, browser information, IP address, mobile network information including device identifiers. 
  • We use cookies to operate and provide our Services, including to provide our Services that are web-based, improve your experiences, understand how our Services are being used, and customize our Services. For example, we use cookies to provide HealMed for web and desktop and other web-based services. We may also use cookies to understand which of our FAQs are most popular and to show you relevant content related to our Services. Additionally, we may use cookies to remember your choices, such as your language preferences, and otherwise to customize our Services for you. 

Third-Party Information

  • Third-Party Providers. We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. For example, we work with companies to distribute our apps, provide our infrastructure, delivery, and other systems, process payments, help us understand how people use our Services, and market our Services. These providers may provide us information about you in certain circumstances; for example, app stores may provide us reports to help us diagnose and fix service issues.

How We Use Information

We use all the information we have to help us operate, provide, improve, understand, customize, support, and market our Services.

  • Our Services. We operate and provide our Services, including providing customer support, and improving, fixing, and customizing our Services. We understand how people use our Services, and analyze and use the information we have to evaluate and improve our Services, research, develop, and test new services and features, and conduct troubleshooting activities. We also use your information to respond to you when you contact us. We use cookies to operate, provide, improve, understand, and customize our Services.
  • Safety and Security.We verify accounts and activity, and promote safety and security on and off our Services, such as by investigating suspicious activity or violations of our Terms, and to ensure our Services are being used legally.
  • No Third-Party Banner Ads. We do not allow third-party banner ads on HealMed. We have no intention to introduce them, but if we ever do, we will update this policy.

Information You And We Share



You share your information as you use and communicate through our Services, and we share your information with Care Providers for your care delivery and also to help us operate, provide, improve, understand, customize, support, and market our Services.

  • Account Information. Your personal information such as name, phone number and address will be shared only with your Care Provider and any other third party approved by your Care Provider.
  • Your Interactions. All your interactions with HealMed Apps (including your video and audio) will be shared with your Care Provider and any third part approved by your Care Provider. You can opt out of recording your video and audio, if you are not comfortable sharing this data with your Care Provider or their approved third parties. 
  • Third-Party Providers. We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. When we share information with third-party providers, we require them to use your information in accordance with our instructions and terms or with express permission from you.

Assignment, Change Of Control, And Transfer

All of our rights and obligations under our Privacy Policy are freely assignable by us to any of our affiliates, in connection with a merger, acquisition, restructuring, or sale of assets, or by operation of law or otherwise, and we may transfer your information to any of our affiliates, successor entities, or new owner.

Managing Your Information

If you would like to manage, change, limit, or delete your information, we allow you to do that through the following tools:

  • Services Options.You can opt out from recording your video and audio during the assessment. In this case, your responses during the assessment will be transcribed by HealMed system and sent to your Care Provider. 
  • Changing Your Mobile Phone Number, Email ID or Address.You can request your Care Provider to change your personal information. Care Provider can change your personal information either in EHR system or in HealMed system. If they are integrated, your updated information will be synchronized. 
  • Deleting Your HealMed Account.You cannot delete your HealMed account directly. You need to request your Care Provider to delete your account. 

Law And Protection

We may collect, use, preserve, and share your information if we have a good-faith belief that it is reasonably necessary to: (a) respond pursuant to applicable law or regulations, to legal process, or to government requests; (b) enforce our Terms and any other applicable terms and policies, including for investigations of potential violations; (c) detect, investigate, prevent, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our users, HealMed, or others.

Our Global Operations

You agree to our information practices, including the collection, use, processing, and sharing of your information as described in this Privacy Policy, as well as the transfer and processing of your information to the United States and other countries globally where we have or use facilities, service providers, or partners, regardless of where you use our Services. You acknowledge that the laws, regulations, and standards of the country in which your information is stored or processed may be different from those of your own country.

Updates To Our Policy

We may amend or update our Privacy Policy. We will provide you notice of amendments to this Privacy Policy, as appropriate, and update the “Last Modified” date at the top of this Privacy Policy. Your continued use of our Services confirms your acceptance of our Privacy Policy, as amended. If you do not agree to our Privacy Policy, as amended, you must stop using our Services. Please review our Privacy Policy from time to time.

HIPAA PRIVACY POLICY ACKNOWLEDGEMENT                                   

This notice describes how your health information, as a patient of HealMed Solutions LLC may be used and disclosed, as well as how you can get access to your health information. This is required by the Privacy Regulations created because of the “Health Insurance Portability and Accountability Act” of 1996 (HIPAA). Our Commitment to your privacy: Your Clinician is dedicated to maintaining the privacy of your health information. We are required by law to maintain the confidentiality of your health information. We realize that these laws are complicated, but we must provide you with the following information:

Use and disclosure of your health information in certain special circumstances: (The following circumstances may require your clinician to use or disclose your health information.)

  1. To public health authorities and health oversight agencies that are authorized by law to collect information.
  2. Lawsuits and similar proceedings in response to court or administrative order.
  3. IF required to do so by a law enforcement official.
  4. When necessary to reduce or prevent a serious threat to your health and safety or the health and safety of another individual or the public. We will only make disclosures to a person or organization able to help prevent the threat and protect from harm.
  5. If you are a member of the U.S. or a foreign military forces (including veterans) and if required by the appropriate authorities.
  6. To federal officials for intelligence and national security activities authorized by law.
  7. To correctional institutions or law enforcement officials if you are an inmate or under custody of a law enforcement official.
  8. For Workers Compensations and similar programs.

Your rights regarding your health information:

 

  1. Communications: You can request that your clinician communicate with you about your health and related issues in a particular manner or at a certain location. For instance, you may ask that we contact you at home, rather than at work. We will accommodate reasonable requests.
  2. You can request a restriction in our use or disclosure of your health information for treatment, payment, or information to only certain individuals involved in your care, the payment of your care, such as family members and friends. We are not required to agree to your request; however, if we do agree, we are bound by our agreement except when otherwise required by law or when the information is necessary to treat you.
  3. You have the right to inspect and obtain a copy of the health information that may be used to make decisions about you including patient medical record and billing records, but not including psychotherapy notes. You must submit your request in writing to HealMed Solutions LLC, and emailing it to admin@healmedsolutions.com
  4. You may ask us to amend your health information if you believe it is incorrect or incomplete, and as long as the information is kept for your clinician. To request an amendment, your request must be made in writing and submitted to your clinician.
  5. Filing a Grievance: You have the right to file a complaint. If you believe that your privacy rights have been violated, you may file a complaint with your clinician or with the Secretary of the Department of Health and Human Services. To file a complaint with your clinician, please submit in writing to your clinician Please note, you will not be penalized for filing a complaint.
  6. Right to a copy of this notice at any time: You are entitled to receive a copy of this Notice of Privacy Policies. You may ask us to give you a copy at any time. To obtain a copy of this notice, contact your clinician’s front reception desk.
  7. Right to provide an authorization for other uses and disclosures: Your clinician will obtain your written authorization for uses and disclosures that are not identified by this notice or permitted by applicable law.

TELEHEALTH SERVICES

Telemedicine involves the use of electronic communications to enable health care providers at different locations to share individual patient medical information for the purpose of improving patient care. Providers may include primary care practitioners, specialists, and/or subspecialists. The information may be used for diagnosis, therapy, follow-up and/or education, and may include any of the following:

  • Patient medical records
  • Medical images
  • Live two-way audio and video
  • Output data from medical devices and sound and video files

Electronic systems used will incorporate network and software security protocols to protect the confidentiality of patient identification and imaging data and will include measures to safeguard the data and to ensure its integrity against intentional or unintentional corruption.

Expected Benefits:

  • Improved access to medical care by enabling a patient to remain in his/her ophthalmologist’s office (or at a remote site) while the physician obtains test results and consults from healthcare practitioners at distant/other sites.
  • More efficient medical evaluation and management.
  • Obtaining expertise of a distant specialist.
  • Possible Risks: As with any medical procedure, there are potential risks associated with the use of telemedicine. These risks include, but may not be limited to:
    • In rare cases, information transmitted may not be sufficient (e.g. poor resolution of images) to allow for appropriate medical decision making by the physician and consultant(s).
    • Delays in medical evaluation and treatment could occur due to deficiencies or failures of the equipment.
    • In very rare instances, security protocols could fail, causing a breach of privacy of personal medical information.
    • In rare cases, a lack of access to complete medical records may result in adverse drug interactions or allergic reactions or other judgment errors.

 

 



 

BY AGREEING TO THIS, I UNDERSTAND THE FOLLOWING:

 

  1. I understand that the laws that protect privacy and the confidentiality of medical information also apply to telemedicine, and that no information obtained in the use of telemedicine which identifies me will be disclosed to researchers or other entities without my consent.
  2. I understand that I have the right to withhold or withdraw my consent to the use of telemedicine in the course of my care at any time, without affecting my right to future care or treatment.
  3. I understand that I have the right to inspect all information obtained and recorded in the course of a telemedicine interaction, and may receive copies of this information for a reasonable fee.
  4. I understand that a variety of alternative methods of medical care may be available to me, and that I may choose one or more of these at any time. My care provider has explained the alternatives to my satisfaction.
  5. I understand that telemedicine may involve electronic communication of my personal medical information including the video recording of my interactions with HealMed system to other medical practitioners who may be located in other areas, including out of state.
  6. I understand that it is my duty to inform my care provider of electronic interactions regarding my care that I may have with other healthcare Users.
  7. I understand that I may expect the anticipated benefits from the use of telemedicine in my care, but that no results can be guaranteed or assured.
